Delhi: Landmark Judgment on Recruitment of SEs

IN THE HIGH COURT OF DELHI AT NEW DELHI W.P.(C) 1200/2016 ordered “We allow this petition in the aforesaid terms and direct the respondents to ensure compliance qua the petitioner within the next four weeks, by granting him relaxation with regard to his age and considering his appointment to the post of SET on the basis of his merit position in the selection process already concluded. He will, however, be entitled to all benefits resulting from the said appointment, only from the date of his actual appointment to the said post. The respondents will also initiate the process for fresh recruitment to the post of SET, as directed hereinabove, within the same period of four weeks.”

MHRD: Complying with the provisions of the Rights of Persons with Disabilities Act, 2016

The Rights of Persons with Disabilities (RPwD) Act, 2016 has been brought into force w.e.f. 19.04.2017. The new Act has expanded the horizon of the rights of persons with disabilities Wz-a-viz the repealed Persons with Disabilities (PwD) Act, 1995. It casts increased responsibilities on the Government authorities to ensure that the persons with disabilities enjoy their rights equally with others and also for their empowerment.

Chapter III of the RPwD Act, 2016 is related to the Education of children with disabilities. Section 16 and 17 of the RPwD Act, inter-alia, makes provisions in respect of Implementation of Inclusive Education for Children with Disabilities. The Schedule to the RPwD Act, 2016 specifies the disability mentioned in the Act.

It is requested that appropriate instructions may be issued to all the establishments under your administrative control to comply with the provisions of the RPwD Act, 2016.
